These Terms and Conditions govern the sale of trees, use of website, and related services by Underground Trees LTD and undergroundtrees.co.uk, here referred to as “We, our or us”.
The customer, by purchasing from us, agrees to these Terms and Conditions.


Orders

Orders must be received in writing via email or through the online shop. Orders will be acknowledged in writing. We cannot be responsible for any orders that have not been acknowledged.


Product Description and Pricing

Due to the nature of our product there will be natural variance from those depicted on our website and social media channels due to growth habits, climatic conditions and seasonal change. We try to provide accurate descriptions of products but cannot guarantee any variation from those stated. Although we adhere to organic growing principles, we are not as yet certified as organic but intend to apply for certification in the coming years.

Prices will be either those listed on the website or made available through email. We reserve the right to change the prices on a regualr basis. The final price will be confirmed when we acknowledge acceptance of your order.

Payment

New customers will be required to make payment before shipment of goods. We accept credit and debit card payments through the website and also accept payments via bank transfer.

Returns

Any issues with delivered goods must be raised within 7 days.
We reserve the right whether to accept any returns. Any goods returned must be undamaged and fit for resale and refunds will only be made if we deem this to be the case.

Cancellations

We reserve the right to retain the full value of the order in the event of cancellation. Only via prior agreement will returns or refunds be considered.

Liability

We aim to produce strong, resilient trees but cannot guarantee their performance once planted out due to the many factors outwith our control. Any complaints must be made to us in writing within 7 days of receipt of goods otherwise they will be considered accepted. Liability is limited to the purchase price of the product.
We can accept no liability for any claims related to any information supplied on our website or our social media channels nor can we guarantee the factual accuracy of information provided.

Acceptance of Terms and Conditions

By placing an order you agree to our terms and conditions. These terms are governed by Scottish law and subject to the jurisdiction of the Scottish courts.

Force Majeure

We are not liable for delays or failures in delivery due to events beyond our reasonable control, such as adverse weather or transport issues.

Delivery

We cannot be liable for any losses caused by the receipt of incorrect delivery addresses, or losses or damages during delivery, nor shall we be liable for any losses to the customer or any third party due to a delay of delivery.

We reserve the right to amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting to our website or notification to you. It is your responsibility to review these Terms and Conditions periodically for updates. Your continued use of our services or the purchase of our products following the posting of changes will mean that you accept and agree to the changes.
